银发经济下老年消费权益保护研究——以保健品、智能养老产品为视角

Abstract: 随着我国人口老龄化进程持续深化，银发经济已成为驱动经济高质量发展的新增长极，规模日益庞大的老年群体，其多元、升级的美好生活需要，正是扩大内需、畅通国民经济循环不可或缺的强劲动力。老年群体的消费需求也从求生存到追品质，保健品与智能养老产品凭借对老年群体健康保障、生活照料需求的精准适配，迅速成为老年消费市场的核心领域。但老年群体生理机能衰退、风险辨识能力较弱、数字素养不足的天然弱势等问题导致老年消费权益受侵害事件屡禁不止，这既严重损害了老年群体的人身财产权益与消费安全感，也制约了银发经济的健康有序发展。本文以保健品、智能养老产品消费场景为特定研究视角梳理银发经济下老年消费权益保护现状，深入剖析权益侵害的核心成因及现有保护体系的不足，借鉴日本先进立法与实践经验，结合我国国情，从法律体系完善、监管机制优化、维权渠道畅通、主体责任强化等维度提出针对性的老年消费权益保护完善路径。
With the continuous deepening of population aging in China, the silver economy has become a new growth engine driving high-quality economic development. The increasingly large elderly group, with their diverse and upgraded needs for a better life, constitutes an indispensable and strong driving force for expanding domestic demand and smoothing the national economic cycle. The consumption demand of the elderly has shifted from survival to quality. By precisely meeting the elderly’s needs for health protection and daily care, health products and smart elderly care products have rapidly emerged as core sectors in the elderly consumption market. However, due to the inherent vulnerabilities of the elderly, such as declining physiological functions, weak risk identification ability, and insufficient digital literacy, infringements on the rights and interests of elderly consumers occur repeatedly. These practices not only seriously damage the personal and property rights and consumption security of the elderly, but also restrict the healthy and orderly development of the silver economy. From the specific perspective of consumption scenarios of health products and smart elderly care products, this paper sorts out the current situation of the protection of elderly consumers’ rights and interests under the silver economy, deeply analyzes the core causes of such infringements and the deficiencies of the existing protection system. Drawing on advanced legislation and practical experience from Japan and combining with China’s national conditions, it proposes targeted improvement paths for protecting elderly consumers’ rights and interests from the perspectives of perfecting the legal system, optimizing the supervision mechanism, smoothing rights protection channels, and strengthening the responsibilities of relevant subjects.

Abstract: Smart home-based care for elderly is the product of the “Internet+” era, along with the information technology and the growing needs for a better elderly life. In order to understand the influencing factors of smart home care in Hengshui city, this paper selected 183 elderly people through a questionnaire survey. The conclusion of the study showed that education level, economic status, sleep quality and residence conditions are the influencing factors affecting the needs of smart home care of the elderly (p < 0.05). Smart home care products for the elderly have a high willingness to use them, especially in terms of life care, medical services and emotional talk, but the compliance still needs to be improved. Development countermeasures suitable for Hengshui city can be put forward through the publicity of smart elderly care services, promoting the construction of demand-oriented big data, and promoting the participation of various forces.

Abstract: 现如今信息技术飞速发展，信息更新迭代速率持续加快，智慧养老作为养老服务业的新兴模式，日益受到社会各界的广泛关注。本文聚焦城市社区老年家庭，深入剖析我国城市社区居家智慧养老服务的发展现状与现存问题，并提出针对性优化对策。当前我国城市社区居家智慧养老服务仍存在诸多短板，主要体现为服务形式单一、老年人对智慧养老模式的认同度低、医疗配套服务供给不足等。针对上述问题，本文从提升老年人智慧养老认同度、完善医疗服务与技术支撑体系、强化高素质专业人才引育等方面提出相应对策建议，以期加快推进我国智慧养老事业的可持续发展。
Nowadays, information technology is developing rapidly with an accelerating pace of information renewal and iteration. As an emerging model in the elderly care service industry, smart elderly care has increasingly attracted extensive attention from all sectors of society. Focusing on elderly families in urban communities, this paper deeply analyzes the current development status and existing problems of home-based smart elderly care services in urban communities of China, and puts forward targeted optimization countermeasures. At present, there are still many shortcomings in the development of home-based smart elderly care services in urban communities in China, which are mainly reflected in the single form of service, low recognition of the smart elderly care model among the elderly, and insufficient supply of supporting medical services. In view of the above problems, this paper proposes corresponding countermeasures and suggestions from the aspects of enhancing the elderly’s recognition of smart elderly care, improving the medical service and technical support system, and strengthening the introduction and cultivation of high-quality professionals, so as to accelerate the sustainable development of China’s smart elderly care industry.

Abstract: 社区智慧养老被视为缓解养老难的一剂良方，在许多地方实践中，社区智慧养老模式已初具规模。智慧养老凭借其信息化、智能化、个性化的特征，在平衡供需、医食住行、整合资源、监督反馈四个方面发挥其优势。但要真正实现社区智慧养老，需要根据智慧养老的特征，从明确需求与创新服务、技术效能与服务协同、主体协同与人才支持、服务监管与评估机制四个方面入手，稳步推动健康中国的建设和社区智慧养老服务质量的提升。
Community smart pension is regarded as a good solution to ease the difficulties of elderly care, and the community smart pension model has begun to take shape in many local practices. With its information-based, intelligent and personalized characteristics, smart elderly care gives play to its advantages in four aspects: balance of supply and demand, medical, food, housing and transportation, integration of resources, and supervision and feedback. However, in order to truly realize community smart elderly care, it is necessary to steadily promote the construction of a healthy China and the improvement of community smart elderly care service quality according to the characteristics of smart elderly care, in four aspects: clear demand and innovative service, technical efficiency and service collaboration, subject collaboration and talent support, and service supervision and evaluation mechanism.

Abstract: 随着中国社会老龄化趋势的加剧，智慧养老服务体系作为一种创新的养老服务模式，正逐步成为满足老年人多样化需求的重要手段。文章首先回顾了我国智慧养老服务体系的发展现状，指出其在社会普及、产品设计以及人才队伍建设等方面存在的问题。接着，从社会重视程度、老年人知识结构以及产品设计完善度等角度，深入分析了问题产生的原因。为优化智慧养老服务体系的发展路径，文章提出了以下建议：一是加强对智慧养老服务体系的引导和宣传，提高社会认知度；二是强化规划引领，建立统一的智慧养老服务标准和体系；三是重视老年教育，提升老年人的信息素养；四是积极推进智慧养老服务进社区，提升服务可及性；五是积极研发和推广智慧养老服务产品，满足老年人实际需求；六是强化人才培养，建立专业化的养老人才队伍。这些措施的实施将有助于推动我国智慧养老服务体系的健康发展，更好地满足老年人对高品质养老生活的追求，助力健康老龄化的实现。
With the aggravation of China’s aging population, the smart elderly care service system, as an innovative model of elderly care services, is gradually becoming an important means to meet the diverse needs of the elderly. The article first reviews the current development status of China’s smart elderly care service system, pointing out the problems it faces in terms of social popularization, product design, and talent development. Subsequently, from the perspectives of social attention, the knowledge structure of the elderly, and the completeness of product design, the reasons for these problems are analyzed in depth. In order to optimize the development path of the smart elderly care service system, the article proposes the following suggestions: firstly, strengthen the guidance and promotion of the smart elderly care service system to enhance social awareness; secondly, strengthen planning leadership, establish unified standards and systems for smart elderly care services; thirdly, emphasize elderly education to improve the information literacy of the elderly; fourthly, actively promote smart elderly care services into communities to improve service accessibility; fifthly, actively research and develop smart elderly care service products to meet the actual needs of the elderly; sixthly, strengthen talent training and establish a professional elderly care workforce. The implementation of these measures will help promote the healthy development of China’s smart elderly care service system, better meet the elderly’s pursuit of high-quality elderly living, and contribute to achieving healthy aging.

Abstract: 随着中国老龄化进程的加深和“老有所乐”、“老有所用”理念的兴起，养老服务需求逐渐多元化，智慧养老成为了我国养老服务发展的重要方式。兰州市智慧养老起步早、发展缓慢的现实状况为老年群体带来服务供需不匹配、数字壁垒、缺失专业人员、信息安全、政策落实难等问题。本文在分析兰州市智慧养老现状的基础上，指出存在的问题，以此提出相应的对策，推动兰州市智慧养老的进一步发展。
With the deepening of China’s aging process and the rise of the concepts of “happiness in old age” and “usefulness in old age”, the demand for elderly care services has gradually diversified, and smart elderly care has become an important way for the development of elderly care services in China. The reality of early start and slow development of smart elderly care in Lanzhou City has brought problems such as service supply-demand mismatch, digital barriers, lack of professional personnel, information security, and difficult policy implementation for the elderly population. Based on the analysis of the current situation of smart elderly care in Lanzhou City, this article points out the existing problems and proposes corresponding countermeasures to promote the further development of smart elderly care in Lanzhou City.

Abstract: 人口老龄化是全球各国普遍面临的挑战，它对国家的经济、政治、文化、社会结构，乃至生态环境都会产生深远的影响。根据国家统计局数据，中国已显然迈入老龄化社会的行列。为了应对日益严峻的老龄化挑战，我国正积极推动智能技术在养老领域的融合与应用。智慧养老代表了当前技术支持水平最高的养老模式。它依托于信息技术等现代科技手段，为老年人提供了全方位的生活服务与管理，可以有效释放养老压力。通过阅读文献，发现当前智慧养老在实践中存在着建设资金来源有限、复合型人才紧缺、相关的政策不够完善等缺点。而浙江省基于养老服务大数据，构建了一个统一的智慧养老平台，形成了一套全新的政策管理和服务浙江养老的体系。它集成了各市县个性化养老系统数据，为各级用户提供了政务、公共和公益服务，并与市场服务紧密相连。本文以此为基础，提出了注重培育多元主体协同精神、推动全国养老信息数据的互联互通、强化信息支撑以及加强信息安全监管等建议，以期能给予政府以及相关企业一些启示，从而推动智慧养老产业的健康发展。
Population aging is a common challenge faced by countries around the world, which will have a profound impact on the economy, politics, culture, social structure, and even ecological environment of countries. According to the National Bureau of Statistics, China has clearly entered the ranks of an aging society. In order to cope with the increasingly severe challenge of aging, our country is actively promoting the integration and application of intelligent technology in the field of elderly care. Smart elderly care represents the current pension model with the highest level of technical support. It relies on modern scientific and technological means such as information technology to provide a full range of life services and management for the elderly, which can effectively relieve the pressure of pensions. Through reading the literature, the author found that the current smart pension has shortcomings in practice, such as limited sources of construction funds, a shortage of compound talents, and imperfect relevant policies. Based on the big data of elderly care services, Zhejiang Province has built a unified smart elderly care platform, forming a new set of policy management and service systems for Zhejiang elderly care. It integrates the data of personalized elderly care systems in various cities and counties, provides government affairs, public and public welfare services for users at all levels, and is closely linked to market services. Based on this, this paper puts forward suggestions such as focusing on cultivating the spirit of multi-subject synergy, promoting the interconnection of national pension information and data, strengthening information support and strengthening information security supervision, in order to give some enlightenment to the government and relevant enterprises, so as to promote the healthy development of the smart pension industry.

Abstract: 文章调查分析了南通市城乡不同养老机构老年人对智慧养老认知水平、态度及行为生活方式(KAP)的差异，并提出了可行性对策建议。自制《智慧养老KAP评分问卷》，随机抽取南通市辖区农村和城镇养老机构的老年人进行问卷调研，运用描述性分析和相关性分析方法了解了老年人对智慧养老认知水平的差异及影响因素。关于智慧养老认知水平与态度，农村明显低于城镇，可见城镇老人对于智慧养老的了解程度及接受态度明显高于农村老人，且根据差异分析，影响因素主要为文化程度、离退休前职业、是否使用智能手机。文章结合南通市的城乡发展差异，并从智慧养老的基础理论宣讲、使用方式普及等方面入手，为政府创新适合智慧养老发展的养老新政策，提升老年人的晚年生活水平提供参考。
This paper investigated and analyzed the differences in the knowledge level, attitude and behavior lifestyle (KAP) of smart elderly care for the elderly in different elderly care institutions in urban and rural areas of Nantong City, and put forward feasible countermeasures and suggestions. The self-made “Smart Elderly Care KAP Score Questionnaire” was conducted by randomly selecting elderly people in rural and urban elderly care institutions under the jurisdiction of Nantong City for questionnaire investigation, and descriptive analysis and correlation analysis were used to understand the differences in elderly people’s knowledge level of smart elderly care and its influencing factors. As for the knowledge level and attitude of smart elderly care, the rural elderly are significantly lower than the urban elderly, indicating that the urban elderly people’s knowledge level of smart elderly care and acceptance attitude are significantly higher than that of the rural elderly. Moreover, according to the difference analysis, the main influencing factors are education level, occupation before retirement, and whether they use smartphones. In combination with the development difference between urban and rural areas in Nantong City, and from the aspects of the promotion of the basic theory and popularization of the use of smart elderly care, this paper provides references for the government to innovate new policies for the development of smart elderly care and improve the living standards of the elderly in their later years.

With the advancement of digital rural construction, rural smart elderly care has ushered in significant development opportunities. However, in the face of current issues such as the low level of rural smart elderly care services, significant barriers to the application of products and services for the elderly, and the disconnection between the living scenarios of rural elderly groups and smart elderly care products and services, leading to the individualization and fragmentation of rural smart elderly care information data. This paper analyzes the reasons such as the high cost of smart elderly care for rural elderly people, the existence of the digital divide, and the lack of motivation and support for learning and application. It further proposes a collaborative governance strategy involving family participation, government guidance, market operation, and social support. Through multiple paths such as policy innovation, technological empowerment, service optimization, and cultural reshaping, it aims to promote the standardized and professional development of rural smart elderly care, ultimately achieving the strategic goal of rural elderly groups sharing the digital dividend and making contributions to rural revitalization and actively responding to population aging.

Abstract: 2012年，全国老龄办首先提出“智能化养老”的理念，鼓励支持开展智慧养老的实践探索和产业发展。各地因地制宜创新养老模式，文章以积分接力养老模式为例，在分析老龄化带来的养老困境的基础上，通过积分养老的试点，探究该模式带来的发展机遇，联合政府、企业等全社会力量构建积分接力养老模式的实践路径，促进养老的“可持续发展”。
In 2012, the National Office for Aging first proposed the concept of “intelligent elderly care”, en-couraging and supporting the practical exploration and industrial development of intelligent el-derly care. Innovative elderly care models are tailored to local conditions in various regions. Taking the integral relay elderly care model as an example, this article analyzes the elderly care difficulties brought about by aging, explores the development opportunities brought by this model through pilot projects of integral elderly care, and collaborates with governments, enterprises, and other social forces to build a practical path for the integral relay elderly care model, promoting the “sustainable development” of elderly care.
