ABSTRACT: The paper presents a brief discussion about the possibility of application of the criminal institute of the detraction (art. 42 of the Penal Code) in relation to personal protective measures in the Brazilian criminal proceeding. This discussion begins with the amendments brought by Law 12,403/2011 that entered on the digest of criminal procedure several personal measures distinct from prison (art. 319 of the Code of Criminal Procedure). Thus, the text seeks a criterion to conclude whether or not it can detract from the time of sentence of imprisonment imposed to the sentenced the period in which he was subjected to a variety of personal protective measures different from prison.
