No intuito de abordar os pressupostos pelos quais se pauta a constru o do Estado Democrático de Direito, o presente trabalho se concentrará em marcos fundamentais para se chegar a uma nova perspectiva de modelo constitucional, haja vista que surge, ainda que timidamente, algumas alternativas pouco exploradas no Brasil de novos movimentos constitucionais que proporcionam uma abertura de perspectiva diversa da conhecida e difundida entre nós. ABSTRACT: In order to approach the assumptions by which to guide the construction of the Democratic State of Law, this paper will focus on key milestones to reach a new perspective on the constitutional model, considering that arises, albeit tentatively, some alternatives explored in Brazil’s new constitutional movements that provide a different perspective of the opening of known and spread among us.
