RESUMO: O presente artigo exp e o tratamento constitucional do princípio da publicidade processual na Constitui o Federal brasileira de 1988, com t nica no Direito Processual Penal, analisando qual é o propósito de sua positiva o, quais s o as restri es que podem ser impostas à publicidade, e ainda como tal princípio se aplica na fase de investiga o policial, tendo em vista a natureza sigilosa do inquérito policial. ABSTRACT: This article presents the treatment of the constitutional principle of public proceedings in the Brazilian Constitution of 1988, with emphasis on Criminal Procedural Law, analyzing the reason for its inclusion in the Constitution, what are the restrictions that may be imposed on this constitutional principle, and as such principle applies in the police investigation stage, in view of the secret nature of the police investigation.
