ABSTRACT: This article aims to discuss a problem evident in health: the denial of a basic social right which has at its core the principle of human dignity in conflict with the reserve of the possible. Therefore, it is necessary to reinterpret the reserve of the possible, aimed at seeking the interpretation of the real public interest, which should always be a mirror of the primacy of the human dignity in the search range of the existential minimum.
