%X O presente artigo visa ¨¤ discuss o de uma problem¨¢tica evidente em mat¨¦ria de sa¨²de: a negativa de um direito social b¨¢sico que tem em sua ess¨ºncia o princ¨ªpio da dignidade da pessoa humana conflitando com a reserva do poss¨ªvel. logo, faz-se necess¨¢ria a reinterpreta  o da reserva do poss¨ªvel, objetivando a busca da interpreta  o do real interesse p¨²blico, o que sempre dever¨¢ ser um espelho da primazia da dignidade da pessoa humana, na busca do alcance do m¨ªnimo existencial. ABSTRACT: This article aims to discuss a problem evident in health: the denial of a basic social right which has at its core the principle of human dignity in conflict with the reserve of the possible. Therefore, it is necessary to reinterpret the reserve of the possible, aimed at seeking the interpretation of the real public interest, which should always be a mirror of the primacy of the human dignity in the search range of the existential minimum.
