PONDERA O, PRETENS O DE CORRE O E ARGUMENTA O: O MODELO DE ROBERT ALEXY PARA FUNDAMENTA O RACIONAL DA DECIS O – BALANCING, CORRECTNESS PRETENTION AND REASONING: THE ROBERT ALEXY MODEL TO ADJUDICATION’S RATIONAL FOUNDATION

O presente artigo tem como objetivo principal estabelecer a correla o existente no desenvolvimento teórico de Robert Alexy sobre a pondera o de princípios jurídicos como metodologia de decis o judicial e a sua fundamenta o racional. Analisa a pretens o de corre o como categoria própria para estabelecer a integra o entre os atos decisório e discursivo. A justificativa do estudo dá-se pelo progressivo reconhecimento da influência dos Direitos Fundamentais no sistema jurídico, tendo como efeito a hipótese de colis o de princípios, o que envolveria a necessidade da pondera o judicial. Assim, com base em pesquisa bibliográfica sobre a respeito da produ o teórica de Robert Alexy, assume-se que a pretens o de corre o é conceito chave para se compreender a íntima rela o entre a distin o estrutural que caracteriza regras e princípios e a capacidade de fundamenta o racional das decis es judiciais. ABSTRACT: The present article has as main objective to establish the existent correlation in Robert Alexy's theoretical development as the consideration of legal principles as methodology of adjudication and its rational foundation. In fact, as primordial, to recognize the correction pretension as own category to establish the integration among the adjudication and reasoning. The justification of the study is because the progressive recognition of the influence of the Fundamental Rights in the legal system, tends as effect, the hypothesis of collision of legal principles, what would involve the need of balancing. This essay is supported in bibliographical research about Robert Alexy, it is assumed that the correction pretension is key concept to understand the close relationship among the distinction structural proposal between rules and legal principles, with the capacity of rational foundation of the adjudication.
