A APLICA O DA MáXIMA DA PROPORCIONALIDADE NO STF: UM CASO - THE APPLICATION OF MAXIMUM OF THE PROPORTIONALITY IN THE SUPREME COURT: A CASE

O presente artigo pretende investigar a utiliza o da máxima da proporcionalidade por dois Ministros do Supremo Tribunal Federal (STF), tomando como base o Hábeas Corpus no 82.424. Como suporte teórico, será adotado a concep o de Robert Alexy dos princípios enquanto mandados de otimiza o, explicitando a máxima da proporcionalidade em suas três máximas parciais: adequa o, necessidade e proporcionalidade em sentido estrito. Depois disso, será feita uma análise detalhada nos votos dos ministros e uma compara o entre a vis o teórica que têm sobre a máxima da proporcionalidade bem como a forma como a aplicaram no caso. Assim, será feita a verifica o se há a aplica o da máxima da proporcionalidade pelos ministros do STF como afirmaram ter feito quando do julgamento do referido caso. Por fim, será constatado que o emprego da proporcionalidade é um mero artifício retórico. PALAVRAS-CHAVE: Máxima da proporcionalidade. Princípios. Supremo Tribunal Federal. ABSTRACT: This article investigates the use of the proportionality maximum by two Justices of the Supreme Tribunal Federal (STF) drawing on the HC 82,424. Will be adopted as theoretical support the conception of Robert Alexy, of the principles while optimization commands, explaining the proportionality maximum in its three partial maximum: suitability, necessity and proportionality in the narrow sense. After that, there will be a detailed analysis of the votes of Justices and a comparison between the theoretical view that they have on the maxim of proportionality and how applied in the case. So will be checked if there is the application of the maximum of proportionality what STF Justices said they had done when the trial of this case.
