O SISTEMA BRASILEIRO DE INTELIGêNCIA E A AMPLITUDE DO CONTROLE EXTERNO DA ATIVIDADE POLICIAL FEDERAL EXERCIDO PELO MINISTéRIO PúBLICO DA UNI O – THE BRAZILIAN SYSTEM OF INTELLIGENCE AND AMPLITUDE CONTROL OF FEDERAL POLICE ACTIVITY BY FEDERAL PROSECUTOR

O presente artigo procura demonstrar os limites a que o Ministério Público encontra-se juridicamente jungido em sua miss o de controle externo da atividade policial, sobretudo o limite material atinente ao tipo de atividade policial sujeita ao controle ministerial. Destaca-se, para tanto, que tal controle ministerial somente se revelará legítimo se incidir sobre a atividade-fim policial, e n o sobre as atividades policiais exercidas no desempenho de fun es cujo resultado n o se destina ao Ministério Público, tal como ocorre nas atividades de inteligência desenvolvidas pela Polícia Federal enquanto órg o integrante do Sistema Brasileiro de Inteligência (Sisbin). ABSTRACT: This article intends to demonstrate the limits to which the prosecution is legally binded in its task of external control over police activities, especially the material limit regarding the type of police activity submitted to ministerial control. Stands for much that such control will be legal if it relates to police activity-end, and not to the activities exercised in the performance of police functions whose result is not destined for prosecutors, as occurs in intelligence activities developed by the Federal Police as a body member of the Brazilian Intelligence System (BIS).
