电商平台商品包装绿色化法律规制研究
Research on Legal Regulation of Green Packaging for Commodities on E-Commerce Platforms

近年来，随着互联网电商的蓬勃兴起，我国快递业迅速发展。快递运输量和包裹量与日俱增，但同时带来的还有包装废弃物造成的环境污染问题，发展绿色包装是解决这一问题的关键所在。中国现行法律对电商平台商品包装绿色化的规定虽已形成一定框架，但在具体实施和制度设计上仍存在一定缺陷，从而导致包装不规范、部分包装材料难以分解、包装回收率低等常见问题。针对这些现存的问题，文章从强化立法、明确责任、健全监管这些方面提出了制度改进与完善的建议。
In recent years, with the vigorous rise of e-commerce on the Internet, China’s express delivery industry has developed rapidly. The volume of express delivery transportation and the number of packages have been increasing day by day. However, the environmental pollution caused by packaging waste has also emerged as a problem. Developing green packaging is the key to solving this problem. Although China’s current laws have formed a certain framework for the green packaging of e-commerce platform products, there are still certain deficiencies in specific implementation and system design, which leads to common problems such as non-standard packaging, difficulty in decomposing some packaging materials, and low packaging recycling rate. In response to these existing problems, this article puts forward suggestions for system improvement and perfection from the aspects of strengthening legislation, clarifying responsibilities, and improving supervision.
