Abstract:

随着数字化时代的到来,网络直播作为一种新型行业逐渐兴起并以强劲势头快速发展,在网络主播与直播平台之间的用工纠纷不可避免地随之增多。直播行业的特殊性、传统从属性标准滞后性、统一法律规范缺位是当前网络主播与直播平台劳动关系认定难的主要成因。但直播行业并未改变劳动关系本质和从属性,劳动法应回归社会本位,护航新型行业健康发展。当前,传统劳动关系认定标准已无法回应新时代下平台经济变化,不能充分发挥法律调整网络主播与直播平台关系的功能。应灵活解释劳动关系从属性标准,分类别分层次保护劳动者合法权益,明确统一法律规范适用标准。
With the advent of the digital era, the live-streaming industry has emerged as a novel economic sector and developed with robust momentum. Consequently, labor disputes between live-streamers and platforms have inevitably increased. The primary challenges in determining employment relationships in this context stem from the unique nature of the live-streaming industry, the lagging applicability of traditional subordination criteria, and the absence of unified legal standards. Nevertheless, the live-streaming industry does not alter the fundamental nature of employment relationships or their subordination characteristics. Labor law should return to its social-oriented roots to safeguard the healthy development of emerging industries. Currently, conventional employment relationship identification standards fail to adapt to the evolving platform economy and inadequately fulfill the regulatory function of law in governing the relationship between live-streamers and platforms. There is a pressing need to flexibly interpret the subordination criteria for employment relationships, implement tiered and categorized protections for workers’ legitimate rights, and establish clear, uniform legal standards.
