当前，网络侵权现象日益突出，其中一个很大的问题就是错误通知。错误通知规则在我国法律体系中存在已久，但是错误通知的侵权责任仍然存在诸多问题，如错误通知的认定标准存在模糊不清、错误通知归责原则存在分歧、网络平台责任界定不清以及缺少救济机制等。深入问题本身研究，确定错误通知的认定标准，明确错误通知侵权责任适用过错责任归责原则，同时合理界定网络平台的责任，最后构建多元的救济机制，助力维护网络空间治理。
In the Internet era, the phenomenon of network infringement is becoming increasingly prominent, and error notification is one of the major problems. The rule of error notification has existed for a long time in China’s legal system, but there are still many problems in the tort liability of error notification, such as the identification standard of error notification is ambiguous, the principle of error notification liability is different, the responsibility of Internet service providers is not clearly defined, and the relief mechanism is lacking. Conduct in-depth research on the problem itself, determine the identification criteria of error notification, clarify the principle of applying fault liability to the tort liability of error notification, and reasonably define the responsibility of network service providers, and finally build a diversified relief mechanism to help maintain the governance of cyberspace.
