电子商务平台滥用相对优势地位行为的法律规制路径研究

电子商务平台的快速发展引发了一系列滥用相对优势地位的问题。相对优势地位理论主要关注交易双方的依赖性，与之相对的市场支配地位则侧重于经营者的市场控制力。电子商务法第35条为规制此类行为提供了依据，但在实际应用中存在法律适用不明确、执法裁量权过大等问题，对市场竞争秩序造成了挑战。为应对这些挑战，建议通过反不正当竞争法对滥用相对优势地位行为进行明确规制，优化电子商务法中相关条款，以适应电子商务领域的特点，维护电子商务领域公平竞争的市场环境。
The rapid development of e-commerce platforms has led to a series of issues concerning the abuse of relative advantage positions. The theory of relative advantage positions primarily focuses on the dependency between transaction parties, while market dominance emphasizes the market control of operators. Article 35 of the E-Commerce Law provides a basis for regulating such behaviors, but there are issues with unclear legal application and excessive enforcement discretion in practice, which poses challenges to market competition order. To address these challenges, it is suggested that the Anti-Unfair Competition Law should clearly regulate the abuse of relative advantage positions, and optimize the relevant provisions in the E-Commerce Law to adapt to the characteristics of the e-commerce field, thereby maintaining a fair competitive market environment in the e-commerce sector.
