With the development of globalization and modern society, the protection and inheritance of intangible cultural heritage have received widespread attention. The rise of tourism has provided new opportunities for the dissemination and economic value realization of intangible cultural heritage, but it has also brought legal challenges, including inadequate intellectual property protection, uneven distribution of benefits, and over-commercialization. This article will discuss these issues from the perspectives of legislation, judicature, and law enforcement. Firstly, legislation is needed to clarify the definition, scope, and protection principles of intangible cultural heritage and to provide a legal basis for tourism development. Secondly, an effective judicial mechanism should be established to ensure that laws are enforced and violations are punished. Finally, law enforcement supervision should be strengthened to protect intangible cultural heritage from destruction or abuse and to regulate tourism development. Through these measures, the aim is to regulate the tourism development of intangible cultural heritage and promote its sustainable development.
