%X 随着全球化和现代社会的发展&#65292;非物质文化遗产的保护和传承受到广泛关注。旅游业的兴起为非物质文化遗产的传播和经济价值实现提供了新机会&#65292;但也带来了法律挑战&#65292;包括知识产权保护不足、利益分配不均和过度商业化等问题。文章将从立法、司法和执法三个角度来探讨这些问题。首先&#65292;需要通过立法明确非物质文化遗产的定义、范围和保护原则&#65292;并为旅游开发提供法律依据。其次&#65292;建立有效的司法机制以确保法律得到执行并处罚违规行为。最后&#65292;加强执法监管以保护非物质文化遗产不受破坏或滥用&#65292;并规范旅游开发。通过这些措施&#65292;旨在规范非物质文化遗产的旅游开发&#65292;促进其可持续发展。<br>With the development of globalization and modern society, the protection and inheritance of intangible cultural heritage have received widespread attention. The rise of tourism has provided new opportunities for the dissemination and economic value realization of intangible cultural heritage, but it has also brought legal challenges, including inadequate intellectual property protection, uneven distribution of benefits, and over-commercialization. This article will discuss these issues from the perspectives of legislation, judicature, and law enforcement. Firstly, legislation is needed to clarify the definition, scope, and protection principles of intangible cultural heritage and to provide a legal basis for tourism development. Secondly, an effective judicial mechanism should be established to ensure that laws are enforced and violations are punished. Finally, law enforcement supervision should be strengthened to protect intangible cultural heritage from destruction or abuse and to regulate tourism development. Through these measures, the aim is to regulate the tourism development of intangible cultural heritage and promote its sustainable development.
