电商平台企业环境法律责任探究——以餐饮外卖企业为例

Abstract:
随着电子商务领域的蓬勃发展,快递业务量呈现出了爆炸性的增长态势,与此同时,电商企业在运营过程中所使用的包装及其废弃物数量也急剧增加,给生态环境系统带来了前所未有的重负,尤其是餐饮外卖行业的迅猛发展,更是加剧了这一问题的严峻性。当前,我们面临的一个核心挑战在于,多数电商企业在环境法律责任的认知上存在明显不足,缺乏对环保投入的必要重视,这严重制约了其在环境保护方面的作为。因此,为从根本上缓解电商行业带来的环境污染问题,我们亟需深化对电商企业在环境保护中法律责任的认识,并借助法律手段的强制性与约束力,对其运营活动进行规范与引导。本文旨在阐述我国电子商务背景下,餐饮外卖服务行业的当前环境污染状况,对餐饮外卖企业环境法律责任承担缺失的原因进行溯源,并给出餐饮外卖企业的环境法律责任的完善路径。希望通过深入分析电子商务企业在环境责任方面的内在不足和外在阻碍,为我国电子商务企业在主动承担环境责任和实施有效的社会监管方面提供有价值的参考依据,助力我国电商企业绿色可持续发展。
With the booming development of the e-commerce field, the volume of express delivery business has shown explosive growth, and at the same time, the amount of packaging and its waste used by e-commerce enterprises in the course of their operations has also increased dramatically, bringing an unprecedented burden to the ecological environment system, especially the rapid development of the catering takeaway industry, which has exacerbated the severity of this problem. Currently, one of the core challenges we are facing is that most e-commerce enterprises have obvious deficiencies in the cognition of environmental legal responsibilities and lack the necessary attention to environmental protection inputs, which seriously restricts their actions in environmental protection. Therefore, in order to fundamentally alleviate the environmental pollution problems brought about by the e-commerce industry, we urgently need to deepen the understanding of e-commerce enterprises in the environmental protection of the legal responsibility, and by means of legal means of mandatory and binding force, to regulate and guide their operational activities. The purpose of this paper is to elaborate the current environmental pollution situation of the catering takeaway service industry under the background of e-commerce in China, to trace the reasons for the lack of environmental legal responsibility of catering takeaway enterprises, and to give a perfect path for the environmental legal responsibility of catering takeaway enterprises. It is hoped that through in-depth analysis of the intrinsic deficiencies and extrinsic obstacles of e-commerce enterprises in environmental responsibility, it will provide valuable reference basis for China’s e-commerce enterprises to take the initiative to assume environmental responsibility and implement effective social supervision, and help China’s e-commerce enterprises to develop in a green and sustainable way.
