《电子商务法》中通知–删除规则的适用困境与完善
The Predicament and Perfection of the Application of Notice-Deletion Rule in “Electronic Commerce Law”

为保护电商领域知识产权，《中华人民共和国电子商务法》制定“通知–删除”规则以平衡权利人、商户和电商平台的利益。随着电商市场规模不断扩大，“通知–删除”规则的通知成立门槛低、十五天静默期不合理等问题导致通知被滥用，恶意投诉频发，电商平台的形式审查难以再有效保护知识产权。因此，本文主张从形式与实质上明确通知的成立标准，权利人发出通知时提供担保以遏制通知滥用现象，商户可以在十五天静默期内提交保证金而继续经营，电商平台引入专业人士、与专业机构合作对通知进行实质审查，提高审查的准确率，降低平台的法律风险。
In order to protect the intellectual property rights in the field of e-commerce, the “Law of the People’s Republic of China on Electronic Commerce” formulated the “notice-delete” rule to balance the interests of the right holders, merchants and e-commerce platforms. With the increasing size of the e-commerce market, the low threshold for notice establishment and the unreasonable 15-day silent period of notice under the “notice-delete” rule have led to the abuse of notice and the frequent occurrence of malicious complaints, and it is difficult for e-commerce platform to effectively protect intellectual property rights. Therefore, this paper advocates that the establishment standard of notice should be clear in form and substance, that the obligee should provide security when giving notice to curb the abuse of notice, and that the merchant should be able to put up a deposit during the 15-day silent period to continue the business, e-commerce platform to introduce professionals, and professional organizations to conduct substantive review of the notice, improve the accuracy of the review, reduce the platform’s legal risk.
