电子商务平台网络安全主体地位浅析
Analysis on the Subject Status of Network Security for E-commerce Platforms

在电子商务活动中，平台依据服务与管理的双重维度，扮演着不同的角色：从服务角度看，它是交易场所的供应者和交易的中介者；从管理角度看，它则是交易规则的制定者、交易内容的监督者以及交易安全的维护者。这些多元角色与平台自身的组织结构共同塑造了电子商务平台网络安全管理者的主体身份。然而，我国法律对于网络服务提供者的定义模糊，这导致在实践中，电子商务平台实施的危害行为往往因其不属于《刑法》所界定的网络服务提供者范畴，或未达到单位犯罪的认定标准，而无法承担相应的法律责任。本文选取电子商务活动中平台的服务内容、管理内容与社会地位作为切入点，明确电子商务平台作为网络服务提供者和网络空间守门人的网络安全管理主体身份。
In e-commerce activities, the platform plays different roles according to the dual dimensions of service and management: from the perspective of service, it is the supplier of the trading venue and the intermediary of the transaction; from a management point of view, it is the formulator of transaction rules, the supervisor of transaction content, and the maintainer of transaction security. These multiple roles, together with the platform’s own organizational structure, shape the main identity of the e-commerce platform’s network security manager. However, the definition of network service providers in Chinese law is vague, which leads to the fact that in practice, the harmful acts carried out by e-commerce platforms are often unable to bear the corresponding legal responsibility because they do not fall within the scope of network service providers as defined in the Criminal Law, or because they do not meet the criteria for determining crimes committed by units. This paper selects the service content, management content and social status of the platform in e-commerce activities as the entry point to clarify the identity of the e-commerce platform as a network service provider and a gatekeeper of cyberspace.
