我国快递绿色包装法律制度研究
Research on the Legal System of Green Packaging for Express Delivery in China

随着电子商务的蓬勃发展，我国快递业务量逐年增加，推进快递包装绿色化进程刻不容缓。首先对绿色包装的含义进行分析，提出我国快递绿色包装绿色化之必要性，即有利于生态文明建设的推进，突破绿色贸易壁垒及加强企业环境责任，实现公民环境权。其次通过分析我国快递绿色包装法制现状，得出快递包装绿色化存在立法体系化程度低、责任主体不清、监管薄弱的现实困难。最后，针对这些困难提出完善建议：一是制定完善的快递绿色包装法律法规体系；二是明确快递绿色包装各环节的责任主体；三是合理划分监管权限，加强监管的实施。
With the vigorous development of e-commerce, the volume of express delivery business in China has increased year by year, so it is urgent to promote the green process of express delivery packaging. Firstly, the meaning of green packaging is analyzed, and the necessity of green packaging for express delivery in China is put forward, which is conducive to the promotion of ecological civilization construction, breaking through green trade barriers, strengthening corporate environmental responsibility and realizing citizens’ environmental rights. Secondly, by analyzing the current legal situation of green express packaging in China, it is concluded that there are practical difficulties in green express packaging, such as low legislative systematization, unclear responsible subjects and weak supervision. Finally, in view of these difficulties, some suggestions are put forward: the first is to formulate a perfect system of laws and regulations on green packaging for express delivery; the second is to clarify the responsible subject of each link of express green packaging; the third is to rationally divide the supervision authority and strengthen the implementation of supervision.
