Abstract:

随着“互联网+”战略的推进,电子商务行业迅猛增长,消费者个人信息成为了极为重要的资产。然而,因为网络平台与商家对信息的商业利用,消费者的隐私权保护遭遇了前所未有的风险。因此,需要在厘清电子商务个人信息特殊性质的基础上,探讨电子商务个人信息保护的现实挑战,并从立法、监管、救济三个方面提出对应的纾解路径,以促进电子商务行业的长期和健康发展。
With the emergence of the new “Internet plus” format, the e-commerce industry has developed rapidly, in which consumer personal information plays an important role and becomes the most popular resource with the help of the rapid spread of the Internet. Especially in the field of e-commerce, due to the commercial value of personal information being seized by network platforms and operators, consumer personal information protection often faces severe challenges. There is still great room for progress in the legal efforts to protect consumer personal information rights, and it is urgent to promote institutional optimization governance with social forces. Therefore, it is necessary to clarify the practical challenges and relief paths of personal information protection in e-commerce, in order to help the long-term and healthy development of the e-commerce industry.
