论电子商务平台经营者的安全保障义务
On the Security Obligations of E-Commerce Platform Operators

在信息技术不断发展的时代下，电子商务平台的出现极大地方便了人们的日常生活交易，利用电子商务平台进行的活动越来越多，电子商务平台的类型也逐渐丰富，为更好地保护消费者权益，我国《电子商务法》对电子商务领域的法律问题作出了一系列的规定，在涉及消费者生命健康问题时，设立了电子商务平台经营者有安全保障义务的规定，这是安全保障义务延伸至电子商务领域的体现，但对于这一义务的内容、标准以及违反该义务所要承担的责任等方面的规定较为模糊，不利于实践中的理解运用。对此，本文在厘清电子商务平台经营者安全保障义务相关理论的基础上，对该安全保障义务的内容、标准及法律责任等方面展开讨论与论证，丰富该安全保障义务内涵，以实现电商平台各主体之间合理的权利义务分配。
In the era of continuous development of information technology, the emergence of e-commerce platforms has greatly facilitated people’s daily life transactions. More and more activities are carried out using e-commerce platforms, and the types of e-commerce platforms are gradually becoming more diverse. In order to better protect consumer rights and interests, China’s E-Commerce Law has made a series of provisions on legal issues in the field of e-commerce. When it comes to consumer life and health issues, it has established provisions for e-commerce platform operators to have security obligations, which is a manifestation of the extension of security obligations to the field of e-commerce. However, the content, standards, and responsibilities for violating this obligation are relatively vague, which is not conducive to practical understanding and application. On the basis of clarifying the relevant theories of the security obligations of e-commerce platform operators, this article discusses and demonstrates the content, standards, and legal responsibilities of this security obligation, enriching the connotation of this security obligation, in order to achieve a reasonable distribution of rights and obligations among the various entities of e-commerce platforms.
