电商平台ODR研究——以闲鱼小法庭为例
Research on ODR in E-Commerce Platforms—Taking Xianyu Small Court as an Example

电商经济的飞速发展导致了巨量的交易纠纷，电商平台因此开始尝试建立能够便捷高效地处理纠纷的ODR机制，闲鱼小法庭正是其中的佼佼者。闲鱼小法庭在社区内部与外部都有着合法性来源，但其裁判结果并不对用户产生强制性约束。在承认这一制度在用户、平台、社会三个维度所具有的优越性的同时，也必须看到其在裁判人员选拔、程序严谨性及结果执行力方面存在的局限性。通过建立与司法ODR的衔接机制、完善解纷人员职业规范和优化评审程序，提升用户参与度，以进一步发展和完善闲鱼等电商平台的ODR机制。
The swift growth of e-commerce has given rise to a plethora of transactional disputes, leading platforms to initiate ODR systems for efficient dispute resolution, with Xianyu’s Small Court standing out. Legitimate within and beyond its community, the Small Court’s decisions, however, lack compulsory enforcement. While its advantages for users, platforms, and society are evident, limitations in adjudicator selection, procedural strictness, and outcome enforceability are apparent. To advance and refine ODR mechanisms on platforms such as Xianyu, establishing connections with judicial ODR, enhancing dispute resolver professionalism, and improving the review process to increase user engagement are essential steps.
