网络购物不正当信用评价规制研究

Abstract:
随着数字时代的到来,网络经济蓬勃发展,网络购物已成为最日常的购物方式。网络购物极大地方便我们的生活的同时,也加深了消费者与平台经营者之间的信息不对称问题,其中不正当信用评价则是其表现之一。本文介绍了不正当信用评价的特征以及表现形式;并分析了产生不正当引用评价的原因,包括再提出网络购物不正当信用评价规制的建议,如从立法角度规范权利的行使,从平台角度明确平台的处理权限等,以此解决不正当信用评价对公平竞争以及消费者权益造成的侵害。
With the development of the digital era, the online economy has flourished, and online shopping has become the most common way of purchasing goods. While online shopping has greatly facilitated our lives, it has also exacerbated the problem of information asymmetry between consumers and platform operators, with unethical credit evaluations being one of the manifestations. This article introduces the characteristics of unethical credit evaluations—the covert nature of the behavior and the extensive scope of its dissemination, as well as the manifestations of unethical credit evaluations in online shopping, including fake positive reviews and malicious negative reviews. Finally, suggestions for regulating unethical credit evaluations in online shopping are proposed, such as standardizing the exercise of rights from a legislative perspective and clarifying the handling authority of platforms, in order to address the infringement of unethical credit evaluations on fair competition and consumer rights.
