网络平台独家交易行为是否应受到反垄断法的规制，需要把焦点放在该行为的违法性认定之上。在反垄断机构执法实践中，通常将相关市场的界定作为前置程序，而网络平台的独特属性给传统相关市场的界定方法带来一定的挑战，但并不意味着传统方法的失灵。独家交易给网络平台的一系列主体造成了损害，导致市场封锁、消费者福利减损。不过也不能否认该行为也存在抗辩理由，为防止出现执法过度现象，执法机构在执法过程中需要综合分析。
