《电子商务法》“通知–删除”规则适用研究
Study on the Application of the “Notice-Delete” Rule in the Electronic Commerce Law of the People’s Republic of China

《中华人民共和国电子商务法》中“通知–删除”规则的确立为电商领域知识产权侵权纠纷提供了救济路径。然而，“通知–删除”规则在实际应用中存在电商平台的审查义务与能力不匹配、权利人与平台内经营者风险分配不均等情况，甚至成为权利人谋求不正当利益的工具。本文在结合“通知–删除”规则演变进程的基础上，分析该规则未达到立法初衷的缘由，并重新审视电商平台经营者的权责，以更好地实现该规则的立法目的，促进电商平台知识产权保护生态的良性发展。
The establishment of the “Notice-Delete” Rule in the Electronic Commerce Law of the People’s Republic of China has provided a relief path for intellectual property infringement disputes in the field of e-commerce. However, in the practical application of the “Notice-Delete” Rule, there is a mismatch between the examination obligation and ability of the e-commerce platform, and the uneven distribution of risks between the right holder and the platform operator, which even becomes a tool for the right holder to seek undue benefits. Based on the evolution of the “Notice-Delete” Rule, this article analyses the reasons why the rule fails to meet the original legislative intent, and re-examines the rights and responsibilities of e-commerce platform operators, so as to better achieve the legislative purpose of the rule and promote the benign development of the e-commerce platform’s intellectual property protection ecology.
