Abstract:

数据隐私保护一般被认为属于产品质量和消费者福利的组成部分,反垄断法的实施对其具有积极的促进作用。然而,互联网企业的双边市场特性决定其无论提供还是改善服务都离不开数据收集活动。用户则因认知局限和使用偏好致使其无法选择隐私安全程度更高的产品。非价格因素分析范式的缺失导致在隐私保护下降的同时消费者利益是否受损难以明晰。竞争的局限性和法律适用的不确定性导致通过反垄断法保护数据隐私的愿景难以实现,优先适用数据隐私法处理隐私安全问题是应然选择。
Data privacy protection is generally regarded as a part of product quality and consumer welfare, and the implementation of anti-monopoly law has a positive role in promoting it. The two-sided market characteristics of Internet enterprises determine that they cannot provide or improve services without data collection activities. Users are unable to choose products with higher privacy security due to cognitive limitations and use preferences. The absence of analysis paradigm also makes it difficult to clarify whether consumer interests are harmed while privacy protection is declining. The limitation of competition and the uncertainty of law application make it difficult to realize the vision of data privacy protection through anti-monopoly law, so it is an appropriate choice to prioritize data privacy law to deal with privacy security issues.
