公职人员直播带货存在的风险及化解路径

Abstract:
在直播带货高度发展的今天，公职人员直播带货已经成为了一个普遍的现象。公职人员直播带货由于直播主体的特殊性，存在着廉洁腐化风险、公众信任破灭风险以及法律价值理念冲突风险，要化解这些风险需要建立合理的激励机制，同时构建对应的竞业禁止制度；规范直播行为，建立公众信任缓冲地带；加快制定规范，明确公职人员直播带货的法律边界。
In today’s highly developed era of live streaming sales, live streaming sales by public officials has become a common risk. Due to the special nature of the live streaming subject, there are risks of corruption, public trust destruction, and institutional conflicts in the live streaming sales of public officials. To resolve these risks, it is necessary to establish a reasonable incentive mechanism and establish corresponding non compete systems; standardize live streaming behavior and establish a buffer zone of public trust; accelerate the formulation of regulations and clarify the legal boundaries of live streaming sales for public officials.
