电商平台中刷单行为的刑法规制

刷单行为在电商平台中长期存在，给互联网市场经济秩序造成了严重的不良影响。当前，在我国法律体系中，主要通过民法、行政法、经济法等法律对刷单行为进行规制，对刷单行为的惩处大多通过行政处罚进行，在刑事法律领域，没有专门的罪名对刷单行为进行规制，而行政处罚已不足以规制电商平台中的刷单行为。通过对刷单行为的性质、种类分析，以反向刷单行为为例，提出以刑法对刷单行为进行规制的路径，以此来维护电商平台的市场经济秩序和经营者之间公平公正的正向竞争，促进电商平台市场经济的蓬勃发展。
Click farming has existed for a long time in e-commerce platforms, which has caused a serious adverse impact on the economic order of the Internet market. At present, in China’s legal system, mainly through civil law, administrative law, economic law and other laws to regulate the click farming, most of the punishments for click farming are carried out through administrative penalties, and in the field of criminal law, there is no special crime to regulate click farming, and administrative penalties are no longer enough to regulate the click farming in e-commerce platforms. Through the analysis of the nature and types of click farming, taking reverse click farming as an example, this paper proposes a path to regulate the click farming by criminal law, so as to maintain the market economic order of the e-commerce platform and the fair and just positive competition between operators, and promote the vigorous development of the market economy of the e-commerce platform.
