随着数字时代的到来，身边出现了越来越多的数字化资源。为了适应现代数字化的发展趋势，提高诉讼效率，在线诉讼也成为我国探索诉讼新方式的路径之一。在线诉讼发展目的之一是为了提高诉讼效率，电子送达制度作为诉讼程序的重要一环，其电子送达的适用规定、送达方式以及缺乏救济制度等原因不利于在线诉讼的发展，因此，在立足于在线诉讼实践发展的基础上完善电子送达制度，有利于在线诉讼发展过程中进一步提高诉讼效率。
