低龄青少年犯罪适用“情节恶劣”的判断原则

2021年3月1日正式生效的《刑法修正案(十一)》将刑事责任年龄下降到了12周岁，并且严格规定只有在同时满足“犯故意杀人、故意伤害罪”、“致人死亡或者以特别残忍的手段致人重伤造成严重残疾”、“情节恶劣”、“经最高人民法院追诉”这几个要件时才可以追究其刑事责任。在这几个要件中，“情节恶劣”的标准较其他几个更为宽泛，给法官的自由裁量空间较大，因此有必要从多方面对适用“情节恶劣”标准的原则展开讨论，并对其加以一定的限制，从而更好地平衡刑法保护社会、保障人权的作用。

Among these elements, the standard of “execrable circumstances” is more obscure than the others, which gives a large space for the judge's discretion. Thus the standard of using “execrable circumstances” must be discussed from vast aspects and put some limitations on it to better balance the role of criminal law in protecting the society and pro-tecting human rights.
