The Principle of Judging “Execrable Circumstances” in Juvenile Delinquency %A 袁炜明 %J Open Journal of Legal Science %P 1657-1662 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/OJLS.2024.123238 %X 2021年3月1日正式生效的《刑法修正案(十一)》将刑事责任年龄下降到了12周岁,并且严格规定只有在同时满足“犯故意杀人、故意伤害罪”、“致人死亡或者以特别残忍的手段致人重伤造成严重残疾”、“情节恶劣”、“经最高人民法院追诉”这几个要件时才可以追究其刑事责任。在这几个要件中,“情节恶劣”的标准较其他几个更为宽泛,给法官的自由裁量空间较大,因此有必要从多方面对适用“情节恶劣”标准的原则展开讨论,并对其加以一定的限制,从而更好地平衡刑法保护社会、保障人权的作用。

Among these elements, the standard of “execrable circumstances” is more obscure than the others, which gives a large space for the judge's discretion.
