The problem of malicious intellectual property complaints has become a major obstacle to the development of the digital economy. Under the influence and interest of the “notice-delete” rule, complainants in the e-commerce platform make use of intellectual property rights to complain, so that complainants have suffered huge losses and damaged the platform environment. To solve this problem, it is necessary to first type the phenomenon, analyze its causes, and apply the right medicine on the basis of tracing the source of the rule. Malicious complaint is an act of unfair competition on the Internet, which should play the role of platform autonomy according to its characteristics, and cooperate with corresponding measures to achieve the balance of interests of the three parties. Judicial trials should pass on their views and attitudes through typical cases, so as to build a good Internet business environment.
