Legal Regulation of Malicious Complaint of Intellectual Property Rights of E-Commerce Platform %A 吴湾湾 %J Open Journal of Legal Science %P 5811-5817 %@ 2329-7379 %D 2023 %I Hans Publishing %R 10.12677/OJLS.2023.116831 %X 知识产权恶意投诉问题已经成为数字经济发展的一大阻碍。在“通知–删除”规则的影响和利益的诱导下,电商平台中的投诉人借助知识产权进行投诉,使投诉人遭受了巨大损失,破坏了平台环境。想要解决该问题首先需要类型化该现象,分析其原因,并在溯源该规则的基础之上对症下药。恶意投诉是互联网不正当竞争的行为,应当根据其特点发挥平台自治的作用,并配合相应措施实现三方主体的利益平衡。司法审判应通过典型案例传递其观点态度,从而构建良好的互联网营商环境。
The problem of malicious intellectual property complaints has become a major obstacle to the development of the digital economy. Under the influence and interest of the “notice-delete” rule, complainants in the e-commerce platform make use of intellectual property rights to complain, so that complainants have suffered huge losses and damaged the platform environment. To solve this problem, it is necessary to first type the phenomenon, analyze its causes, and apply the right medicine on the basis of tracing the source of the rule. Malicious complaint is an act of unfair competition on the Internet, which should play the role of platform autonomy according to its characteristics, and cooperate with corresponding measures to achieve the balance of interests of the three parties.
