海洋微塑料污染国际法规制的困境及出路

海洋微塑料污染具有区别于传统塑料污染的独特属性，使得基于传统塑料污染构建的国际立法出现了一定程度的适用困境，如当前国际立法缺乏体系性、在应对海洋微塑料污染时缺乏可操作性、部分缔约国不遵守国际立法。面对这些困境，有必要对海洋微塑料污染防治进行单独立法、加强海洋微塑料污染防治国际立法的可操作性、确保缔约国严格遵守海洋微塑料污染防治的国际立法，以期为应对海洋微塑料污染提供有力的国际法支撑。
Marine microplastic pollution has unique attributes that distinguish it from traditional plastic pollution, making international legislation constructed on the basis of traditional plastic pollution subject to a certain degree of applicability dilemmas, such as the lack of systemic nature of current international legislation, the lack of operationalization in dealing with marine microplastic pollution, and the non-compliance of some contracting parties with international legislation. In the face of these dilemmas, it is necessary to enact separate legislation on the prevention and control of marine microplastic pollution, to strengthen the operability of international legislation on the prevention and control of marine microplastic pollution, and to ensure that States parties strictly comply with international legislation on the prevention and control of marine microplastic pollution, with a view to providing strong international law support for the response to marine microplastic pollution.
