标准合同是个人信息出境规则极重要的组成，上位法、相关法的根系深埋其中。本文运用体系解释进行规范分析，研究标准合同法律关系的构建。在法律主体方面，将个人信息处理者、境外接收方限缩解释为企业、出境非自身或家庭事务相关信息的自然人、非法律法规授权的其他组织；在法律客体方面，借助相关法，解释“非关键信息基础设施运营者”的法律表述不准确；在法律关系内容方面，细分不同主体的权利、义务。
