%X 标准合同是个人信息出境规则极重要的组成，上位法、相关法的根系深埋其中。本文运用体系解释进行规范分析，研究标准合同法律关系的构建。在法律主体方面，将个人信息处理者、境外接收方限缩解释为企业、出境非自身或家庭事务相关信息的自然人、非法律法规授权的其他组织；在法律客体方面，借助相关法，解释“非关键信息基础设施运营者”的法律表述不准确；在法律关系内容方面，细分不同主体的权利、义务。<br />
Standard contract is an extremely important component of personal information export rules, and the roots of upper level and related laws are deeply embedded in them. This article uses systematic interpretation for normative analysis to study the legal relationship in Standard Contract. In terms of Legal person, the exporter and the importer are interpreted as enterprises, natural persons who leave the country and are not related to their own or family affairs, or other organizations authorized by laws and regulations; In terms of legal object, with the help of relevant laws, explaining that “Non Key Information Infrastructure Operators” is an inaccurate legal statement; In terms of legal relationship content, we subdivide the rights and obligations of different subjects based on their different subjects.
