TRANSMISSA？O UNILATERAL SUBJETIVA ATIVA DAS OBRIGAC？O？ES: CESSA？O DO CRE？DITO

This paper aims to analyze the credit assignment figure that is one of the species of subjective transmission of obligations in Brazilian private law. The figure is based on the right to transmit personal credits, which derives from the autonomy of the will, and which allows the subjects of law to dispose of the existing credits in their assets. The figure is presented taking the “obligation as a process”, giving rise to an understanding of the role of contractors in the context of their mutual relations.
