The author reflects on the relationship between the victim and the offender during the period of the execution of the judgment underlining that the attention to this topic is unusual. Even if there is a focus on this topic, the author argues that the risk today is that the attention to this relationship during prison term becomes only a technique of paraclinical interview or a generic mediation, neglecting the central themes of truth, responsibility, power and authority. Although, in the author’s opinion, these topics are strictly linked to reformation and/or re-education.Even if it is very hard to theorize about the legitimacy of punishment, the author, from an ethical point of view, hopes for a change toward restorative justice and reconciliation opportunities coming from mediation mechanisms. L’auteur réfléchit sur le rapport entre la victime et le coupable pendant la période de l’exécution des peines. Il souligne que lorsque l’attention est portée sur ce sujet, ce qui n'arrive que rarement, cette attention risque aujourd’hui de se limiter à une technique de colloque paraclinique ou à une vague médiation, négligeant des thèmes aussi importants que la vérité, la responsabilité, le pouvoir et l’autorité, bien que structurellement liés au repentir et/ou à la rééducation.Même s’il se révèle ardu de théoriser sur la légitimation de la peine, d’un point de vue éthique, l’auteur voit d'un il bienveillant un éventuel changement de cap vers une justice réparatrice et des opportunités de réconciliation qui naissent des mécanismes de médiation.
