%X The author reflects on the relationship between the victim and the offender during the period of the execution of the judgment underlining that the attention to this topic is unusual. Even if there is a focus on this topic, the author argues that the risk today is that the attention to this relationship during prison term becomes only a technique of paraclinical interview or a generic mediation, neglecting the central themes of truth, responsibility, power and authority. Although, in the author¡¯s opinion, these topics are strictly linked to reformation and/or re-education.Even if it is very hard to theorize about the legitimacy of punishment, the author, from an ethical point of view, hopes for a change toward restorative justice and reconciliation opportunities coming from mediation mechanisms. L¡¯auteur r¨¦fl¨¦chit sur le rapport entre la victime et le coupable pendant la p¨¦riode de l¡¯ex¨¦cution des peines. Il souligne que lorsque l¡¯attention est port¨¦e sur ce sujet, ce qui n'arrive que rarement, cette attention risque aujourd¡¯hui de se limiter ¨¤ une technique de colloque paraclinique ou ¨¤ une vague m¨¦diation, n¨¦gligeant des th¨¨mes aussi importants que la v¨¦rit¨¦, la responsabilit¨¦, le pouvoir et l¡¯autorit¨¦, bien que structurellement li¨¦s au repentir et/ou ¨¤ la r¨¦¨¦ducation.M¨ºme s¡¯il se r¨¦v¨¨le ardu de th¨¦oriser sur la l¨¦gitimation de la peine, d¡¯un point de vue ¨¦thique, l¡¯auteur voit d'un  il bienveillant un ¨¦ventuel changement de cap vers une justice r¨¦paratrice et des opportunit¨¦s de r¨¦conciliation qui naissent des m¨¦canismes de m¨¦diation.
