El autor aborda la institución del contrato y el fenómeno de la contratación jurídica contemporánea no sólo desde el punto de vista de la ciencia del derecho, sino desde una dimensión social y axiológica. Se evidencia la importancia que tiene hoy el contrato para todas las esferas de la sociedad moderna y civilizada y de ahí la necesidad de que en el sistema de contratación jurídica estén presentes deberes jurídicos como los de buena fe, cooperación en la interpretación y en la modificación de la relación jurídica por causas fundadas, claridad y precisión en el contenido, y ética en la observancia de la obligatoriedad contractual. Se afianza la idea de que la tecnología al servicio del sistema de la contratación jurídica constituye una herramienta invaluable para el mejor control de ésta y para lograr un mayor rendimiento de recursos. The legal contracting system: an authentic social, scientific and technologic problem, analyses the institution of contract and the phenomenon of the contemporary legal contracting, not just from the point of view of the science of law, but also, and first of all, from a social and axiological dimension. This article shows the importance that contract has today in all spheres of modern and civilized society; hence the need to include legal duties in the legal contracting system. It strengthens the idea that technology at the service of the legal contracting system is an invaluable tool to achieve a good control and a better yield of resources, capacities and contractual relationships that law operators systematically formalized.
