The Termination of the Pregnancy of Anencephalous phetus in Federal Supreme Court: An Analysis of the ADPF [Constitutional Action] 54. A Quest o Da Interrup o Da Gravidez De Feto Anencéfalo No STF – Uma Análise Da ADPF 54

The termination of pregnancy in anancephalie is one of the most polemical and controversial themes in Brazilian Legal Studies and in the last years has risen a number of discussions in the legal area, arriving to the Brazilian Supreme Federal Court [STF] through the ADPF [Fundamental Principle non-abidement Alegation, a Constitutional Action]. The main issue was to verify if terminating the pregnancy of anencephalous phetus would be against the inviolability of the right to life, characterizing the crime of abortion. The objective of this essay is to analyse the ADPF 54, recently decided by the Supreme Court, making the decisions clearer. O cerne da quest o posta em julgamento estava em se verificar se a interrup o da gravidez de feto anencéfalo afrontaria a inviolabilidade do direito à vida, caracterizando o crime de aborto. O objetivo do presente trabalho é fazer uma análise da Argui o de Descumprimento de Preceito Fundamental no 54, julgada recentemente pela Corte Suprema, e explicitar a decis o do Supremo Tribunal Federal acerca do tema.
