NúCLEOS DE ASSESSORIA TéCNICA E JUDICIALIZA O DA SAúDE: CONSTITUCIONAIS OU INCONSTITUCIONAIS? – TECHNICAL ADVICE CENTERS AND “JUDICIALIZATION OF HEALTH”: CONSTITUTIONAL OR UNCONSTITUTIONAL?

RESUMO: O presente trabalho tem como escopo o estudo dos núcleos de assessoria técnica (NATs), órg os inseridos dentro dos tribunais de justi a, com o fim de auxiliar os magistrados nas decis es envolvendo presta es de medicamentos. Ser o observados o crescente processo de judicializa o da saúde e o quanto essa tem atingido o Poder Judiciário e o Poder Executivo; a consequente busca por caminhos para a diminui o desse fen meno através de diálogos institucionais e a cria o de órg os que viabilizem uma interface de consenso entre esses Poderes. ABSTRACT: This work aims at studying the Technical Advice Centers in health related lawsuits, specialized departments inserted within the Courts of Justice, with the order to assist the judges in decisions involving benefits of medicines and health care resources. For such will be analyzed the emergence of the phenomena conventionally called “judicialization of health” and the extent of its effects over both Judiciary and other branches of government; the efforts to find paths that lead to reduction the “judicialization” phenomena through dialogs and spaces of consensus between the Executive and the Judiciary.
