O DIREITO FUNDAMENTAL à GREVE: UMA ANáLISE TRABALHISTA-ADMINISTRATIVA – STRIKE AS A FUNDAMENTAL RIGHT: AN ANALYSIS LABOR-ADMINISTRATIVE

O presente trabalho prop e um estudo acerca do exercício do direito fundamental à greve. Trata-se de um direito bastante debatido, seja no Brasil seja em outros países em que a crise econ mica mundial desencadeou inúmeros movimentos sociais, em especial, grevistas. Apesar de ser um tema relevante e atual, entende-se que ele ainda é carente de estudos interdisciplinares. Assim, buscou-se, primeiramente, fazer uma pesquisa histórica do direito de greve no Brasil, analisando-o sob o prisma dos direitos fundamentais. Em seguida, compreendeu-se como os trabalhadores da iniciativa privada e os servidores públicos civis exercem esse direito, tendo em vista as limita es legais existentes. Por fim, concluiu-se como ainda é difícil conciliar os interesses dos grupos profissionais, por meio da utiliza o da greve, com os da sociedade em geral. PALAVRAS-CHAVE: Greve. Direitos fundamentais. Trabalhador. servidor público. ABSTRACT: This paper proposes a study of the exercise of the fundamental right to strike. It is a right rather debated, whether in Brazil or other countries in which the global economic crisis triggered numerous social movements, especially strikers. Despite being a relevant and current, it is understood that he is still lacking in interdisciplinary studies. Thus, we sought to firstly make a historical survey of the right to strike in Brazil, analyzing it from the perspective of fundamental rights. Then, it was understood as the private sector workers and civil servants exercising this right, in view of the existing legal restrictions. Finally, it was concluded as it is still difficult to reconcile the interests of professional groups, through the use of the strike, with the wider society. KEYWORDS: Strike. Fundamental rights.
