DIREITO à SAúDE: DE NORMA PROGRAMáTICA A DIREITO INDIVIDUAL EXIGíVEL – RIGHT TO HEALTH: FROM PROGRAMMATIC PRINCIPLE TO ENFORCEABLE INDIVIDUAL RIGHT

Nos primeiros anos que se seguiram à promulga o da Constitui o de 1988, o direito à saúde nela previsto era considerado uma norma programática, destinada a orientar o Estado, apontando um fim social a ser atingido. O Supremo Tribunal Federal alterou esta interpreta o inicial, fixando o direito à saúde como um direito individual imediatamente exigível. No entanto, as consequências desta muta o da interpreta o constitucional s o ainda controversas, e podem estar na raiz da chamada “judicializa o da saúde”. PALAVRAS-CHAVE: Direito. Saúde. ABSTRACT: The right to health was considered as a programmatic principle in the early years after the promulgation of the Brazilian’s 1988 Constitution, intended just to guide the State, pointing a social goal to be pursued. Brazilian’s Supreme Court changed this interpretation, setting the right to health as an individual right immediately enforceable. However, the consequences of this change in the constitutional interpretation are still controversial, and they maybe the source of the so called “health’s judicialization”. KEYWORDS: Right. Health.
