DEMOCRACIA, O AUDITóRIO DO SUPREMO TRIBUNAL FEDERAL E O EFEITO VINCULANTE DE SUAS DECIS ES - DEMOCRACY, THE AUDITORIUM OF THE SUPREME COURT AND THE BINDING EFFECTS BY ITS TRIALS

RESUMO: O presente trabalho trata da identifica o do auditório do Supremo Tribunal Federal (STF), com base na teoria da argumenta o de Cha m Perelman, e da caracteriza o das normas jurídicas produzidas pelo Supremo nos julgamentos dos processos constitucionais de sua competência, com eficácia geral, comprovadas através da maior utiliza o da reclama o constitucional para exigência do cumprimento dessas decis es. Analisa o grau de judicializa o em que se encontra a sociedade brasileira e o incremento das decis es com efeitos vinculantes erga omnes do STF. Estuda formas de ensejar maior abertura e participa o democrática, em especial através dos amici curiae e da redu o de discricionariedade judicial nos processos constitucionais cujas decis es possuam efeitos vinculantes, sob a ótica da interpreta o constitucional de Peter H berle e Konrad Hesse. ABSTRACT: This paper deals with the identification of the auditorium of the Supreme Court, based on argumentation theory of Cha m Perelman, and the characterization of the legal rules produced by the trials of Supreme in processes of constitutional jurisdiction, with overall effectiveness, through increased in use of the “reclama o constitucional” for compliance with these decisions. Analyzes the degree of judicialization in Brazilian society and the increase of the decisions with binding effects erga omnes do STF. Study forms give rise to greater openness and democratic participation, particularly through the amici curiae and the reduction of judicial discretion in constitutional processes whose decisions have binding effect, from the standpoint of constitutional interpretation of Peter H berle and Konrad Hesse.
