CONCRETIZA O DA IGUALDADE MATERIAL E POLíTICAS PúBLICAS: VIS O DO SUPREMO TRIBUNAL FEDERAL – CONCRETIZATION OF THE MATERIAL EQUALITY AND PUBLIC POLICIES: SUPREME COURT CONCEPTION

Este artigo contempla apontamentos sobre a necessidade de concretizar-se o direito fundamental de igualdade, com base na reestrutura o das políticas públicas sociais. Enfoca a importancia de esse direito tornar-se concreto na sociedade brasileira e atuar como alavanca de desenvolvimento e promo o da justi a social, assim como legitimar o Estado Democrático. Tem o objetivo de demonstrar a necessidade de se efetivar a igualdade material por meio de políticas sociais reparadoras da desigualdade, partindo da demonstra o desse direito como fundamental, pertencente à 2a dimens o e apregoado na Lei Maior. Toma-se como escopo a diferente conforma o da igualdade em formal e material; a enuncia o do conceito de políticas públicas; o ciclo de elabora o; e problemas mais recorrentes. Por fim, analisam-se os aspectos relativos ao controle jurisdicional das políticas públicas, com base em importantes decis es do Supremo Tribunal Federal compreendidas entre 2009 e 2012 sobre o tema. ABSTRACT: This paper studies the need to concretize the fundamental right to material equality based on a restructuring of reformative public social policies. It focuses on the importance of concretizing the above mentioned right within Brazilian society in order to promote development and social justice and confer legitimacy on the democratic rule of law. Show the real need for the effective implementation of material equality by means of serious social policies capable of remedying inequality within society and to do so it starts out by showing that this right is fundamental, belonging to the second dimension and proclaimed in the Constitution. It also shows the different conformation into formal and material, the expression of the concept of reformative social public policies showing their elaboration cycle and the most frequently occurring problems in terms of the difficulty of carrying them out. It analyzes the aspects about the jurisdictional control of the public policies based with support in some importants decisions of Supreme Court between 2009 and 2012 about the issue.
