NACIó, SíMBOLS I DRETS HISTòRICSKeywords: nation , sovereignty , national symbols , historical rights Abstract: This article deals with the concept of nation used in Catalonia’s 2006 Statuteof Autonomy and the juridical force that, according to the ConstitutionalCourt’s construction, has. The article highlights that in terms of the conceptof nation, the Ruling undermines its interpretative value in the preamble, but does not make reference to any specifi c device, which in addition tochanging the jurisprudence of the Court, also makes its consequences lessprecise. The Ruling, on the other hand and contradictorily, accepts the adjective“nationals” as it refers to symbols, because it understands that in this case “nationals” comes from “nationality”. Finally, it indicates that the ambiguityin article 5 of the Statute leads to the Ruling seeming to declare theAdditional First Provision of the Constitution inapplicable to Catalonia, butit does not clarify the reasons for that inapplicability.
