Analysis of the System of Kin Concealment between Relatives and Modern Legal Tolerance System  [PDF]

Abstract: The concept of “Kin Concealment System” is a traditional legal system in China, which has a profound ideological origin and rich legal practice in ancient China. It has also been a hot topic of discussion in the academic community in recent years. The product of the combination of Confucian culture and Legalist thought in this system played a role in maintaining the stability of state power and consolidating social ethics in the feudal society with a strong patriarchal system. After the founding of the People’s Republic of China, due to various factors, the system of allowing close relatives to hide was not clearly stipulated in the legislative system. Whether in European and American countries or countries and regions influenced by the Chinese legal system, the provision that close relatives can tolerate hiding and sheltering was retained. Overall, the establishment of the system Kin Tolerating and Concealing is conducive to protecting human rights, does not violate socialist morality and values, and is feasible in legal implementation.
Experiences of Family Relationships When a Family Member Has Dementia  [PDF]

Abstract:

Approximately 66 million people worldwide will suffer from dementia in 2030. The dementia’s impact affects people with the disorder and those in their social networks, most notably, their families. This study’s aim was to explore the experiences of family relationships when a family member has dementia. We conducted semi-structured interviews with people diagnosed with dementia, their spouses and adult children. Seventeen participants were interviewed. All participants were recruited in open-ended ongoing structured support groups provided by a Swedish municipality in order to elicit the participants’ subjective experiences on family relationships after the dementia diagnosis. Researchers used content analysis to examine the transcripts. Two main themes were identified, one relating to changed relationships where the participants experienced longing, lost closeness, loneliness and changed sibling relationships. The second theme related to supporting relationships within the family with experiences such as kinship, shared responsibilities and love and appreciation. Support should therefore focus on creating relationships and giving opportunities for conversations about changes within the families and difficult decisions, creating family or team support for those who need it.

Abstract: 《民法典》实行至今已逾四年时间，第1053条规定改变了无效婚姻和可撤销婚姻的具体类型，它在一定程度上保障了公民的婚姻自主权。第1053条作为直接适用于涉重大疾病婚姻的法律规定，在诉讼中起到较为重要的作用，为确保在司法实践过程中的合法有效适用，必须对第1053条所面临的各种现实情况进行解释分析。本文首先对隐瞒重大疾病可撤销婚姻条款的基本涵义进行解释，从一方患有重大疾病、如实告知义务、被隐瞒方撤销权三方面进行论述；其次从司法实践中发现《民法典》第1053条的实施存在“重大疾病”的认定标准不统一、如实告知义务限度不明晰、证明责任分配不合理、婚姻被撤销后过错方损害赔偿范围界定不明等问题。针对上述问题，我们需要从明确重大疾病范围、完善保障当事人知情权的规定和确定过错方赔偿范围角度找到解决路径。
Having been in effect for over four years, Article 1053 of the Civil Code has alteredthe specific categories of void and voidable marriages, there by safe guarding citizens’ marriage autonomy to a certain extent. Article 1053, as a legal provision directly applic able to marriages involving major illnesses, plays a relatively important role in litigation. Inorder to ensure its legal and effective application in judicial practice, it is necessary to interpret and analyze the various practical situations faced by Article 1053. This article first explains the basic meaning of the revocable marriage clause for concealing a major illness, and discusses it from three aspects: one party suffering from amajor illness, the obligation to truthfully inform, and the right of the concealed party to revoke; Secondly, it has been found in judicial practice that the implementation of Article 1053 of the Civil Code has problems such as inconsistent criteria for identifying “major illnesses”, unclear limits on the obligation to truth fully disclose, unreasonable allocation of burden of proof, and unclear definition of the scope of compensation for the fault party after the dissolution of the marriage. To address the above issues, we need to find a solution from the perspectives of clarifying the scope of major diseases, improving regulations to protect the right to know of the parties involved, and determining the scope of compensation for the party at fault.

Abstract: by means of an analysis of fijian children's essays about the future, this paper explores ideas of sociality, personhood and the self that are the very stuff of intersubjectivity and thus of the imagination. the material presented here bears on a single aspect of data derived from 75 essays by fijian village children aged between 7 and 15 years old collected in april 2005: their constitution over time of a spatiotemporal orientation towards a view of generations to come. this partial analysis is the first part of the larger project, which will look at all aspects of the data derived from the essays as they vary together. the paper uses this example of spatiotemporal orientation to show how, seen through the perspective derived from long-term participant observer fieldwork, data such as these enable an ethnographic analysis of meaning-making as a transformational, historical process.

Abstract: I have stories to tell. More than a decade ago and ironically almost a decade after my graduation from medical school, I trained and got certified in basic life support (BLS) skills because I did NOT want to fail my family, my friends and my patients as I had desired to NOT fail my conscience as a physician. I will tell you this that you will never regret honing BLS skills whenever you will see the smiles on the faces of revived and you will never forget when not forgiven – by else and/or by self – for your reluctance in knowing what’s expected from you especially as a physician. Even though my natural desire to hone BLS skills was born in the times when it was NOT mandated, my free will to care for my family, my friends and my patients had always brought me back to BLS training centers for revisiting my skills again and again, years after years. Abstract: Young adulthood is one of the periods of developmental duties such as starting a professional life and choosing a spouse. With the help of developing technology and the intensive use of the internet, young adults use social media in intense ways and prefer social media to initiate and maintain relationships. At the same time, romantic relationships of individuals can sometimes be damaged by deception. This research is a descriptive study aimed at investigating the relationship between the use of social media and the use of social media in young adulthood. The study group consisted of 403 young adults (293 (72.7%) female and 110 (27.3%) male). Social media use scale, attitude towards deceit and intent to deceive scale were used in the research. According to research findings, the results of cross-tabulation according to sexual experience and relationship status of gender variable of young adults were examined. In addition, the extent to which young adults exploit their intent to deceive was examined by means of regression analysis. gender, use of social media, attitudes towards positive-negative deception (attitude scale subdimensions for deception) significantly predicted the intention to deceive variables
