the paper affirms the legitimacy of the judicial review of international treaties under chilean constitutional law. the defense of judicial review is argued from constitutional grounds, that is, the wide interpretation of the concept of "legal precept", the necessity of exceptional control and the renewed signification of the inapplicability judgment. lastly, the thesis about the state responsibility for internationally wrongful act is critically examined.
