Abstract:

the main purpose of this article is to introduce a discussion about the rule of the amicus curiae in brazilian law, considering as theoretical foundations the concepts of open and cultural constitution - and consequently of an #open society of constitutional interpreters# - worked by peter h?berle, those understood as basis that allows and demands an effective participation of citizens in the hermeneutical sphere and in the interpretation of constitutional contents, mainly centered in the notion of status activus processualis, considering that, in the context of a democratic state of law, participation becomes the main status, playing an essential rule in the concretization of public tasks and of fundamental rights, essentially in the context of a constitution seen as a permanent open ended process. it is exactly in this perspective that the instrument of amicus curiae becomes an important procedural mechanism, once that it offers an institutional sphere of participation in process and jurisdiction, powering, in this way, the constitutional debate and contributing to an increase of decisions legitimacy in the ambit of democracy.
